Terms of Service

These Terms govern your use of Pulse (the "Service"), operated by Nexus Production Solutions, LLC ("we", "us"). By creating an account, accepting an invitation, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Beta program (important)

The Service is currently provided as an invite-only beta. You acknowledge and agree that:

  • The Service is provided as-is and as-available, may contain bugs, and is offered with no service-level commitment, uptime guarantee, or warranty.
  • Features, pricing, data models, and APIs may change, be added, or be removed at any time without notice during beta.
  • Beta data may be reset, recalculated, archived, or deleted. You are responsible for exporting any data you need to retain.
  • Production metrics (BHPD, cycle time, full-cycle days, payroll calculations, KPIs) are decision-support tools only. You are solely responsible for verifying outputs before relying on them for pay, billing, scheduling, or any other business or legal purpose.
  • By participating you grant us a non-exclusive, royalty-free, perpetual license to use de-identified usage data and any feedback you provide to improve the Service.
  • We may terminate the beta or your beta access at any time without cause.

2. Eligibility & account

You must be at least 18 years old and authorized to bind your shop. You are responsible for activity under your account and for keeping credentials secure. Shop administrators are responsible for the users they invite and the roles they grant.

3. Acceptable use

Do not use the Service to violate the rights of others, upload unlawful content, attempt to reverse engineer or scrape the Service, or interfere with its operation. We may suspend or terminate access for misuse.

4. Subscriptions & billing

Paid plans renew automatically until canceled. Trials convert to paid plans at the end of the trial period unless canceled. You can manage or cancel from the Upgrade screen. Stripe processes payments; its terms apply to payment processing. Beta pricing may change with notice.

5. SMS / text messaging

The Service can send transactional SMS messages on your behalf (teammate ready alerts, appointment confirmations, reminders). By providing a phone number you confirm you have the right to text that number and agree that message and data rates may apply. Reply STOP to opt out, HELP for help. We do not sell or share phone numbers for marketing.

6. Customer data

You retain ownership of the data you put into the Service. You grant us a limited license to host, process, transmit, and display that data solely to provide the Service to you. See our Privacy Policy for details.

7. Termination & data export

You may delete your account at any time from Settings → Account. After deletion, associated personal data is removed within 30 days from active systems. You can export your data in CSV form at any time from the same screen.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXUS PRODUCTION SOLUTIONS, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). DURING THE BETA, IF YOU ARE NOT PAYING FOR THE SERVICE, OUR AGGREGATE LIABILITY IS LIMITED TO USD $100.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nexus Production Solutions, LLC from any third-party claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your data, or your violation of these Terms.

11. Governing law & disputes

These Terms are governed by the laws of the State in which Nexus Production Solutions, LLC is organized, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in that State, and you consent to personal jurisdiction there. The parties waive any right to a jury trial.

12. Changes

We may update these Terms. Material changes will be communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.
